We use the personal information you share with us to make our products and services, as well as your experience, better and better.


The purpose of this privacy policy is to provide you with a clear view of how we use the personal information you provide to us, our efforts to protect it, your rights, and the options you have to control your personal information and protect your privacy.

Additionally, acceptance of this Privacy Policy also implies your express consent to collect information related to your credit card, as well as regarding the transfer of personal information to third parties located in Mexico or abroad, as will be indicated subsequently in this Privacy Policy. deTule will not collect sensitive personal information from you, such as racial or ethnic origin, health status, religious, philosophical, or moral beliefs, union or political affiliation, or sexual preference. All purposes for which personal information is collected, which will be stated in this Privacy Policy, are necessary for the relationship established here between you and us. You may restrict the use or disclosure of your personal information for purposes other than those that are necessary for said relationship.

At any time, you may access your personal information, and you may likewise rectify said information, cancel, or oppose its use, transfer, storage, or processing that we give to such personal information; except as otherwise provided in accordance with the Data Law, for which we invite you to consult our Privacy Notice. We will use the information you provide to us for various purposes, as described below.

“Personal information” is any information related to you that identifies you personally, whether separately or in combination with other information at our disposal. deTule will collect various types of personal information and various personal data about you, including the following (as applicable):

USE OF OUR PRODUCTS AND SERVICES

When you use our products and services, we will ask for personal information (at the time of collecting Personal Data, we will explain what information is required and what information you may decide to provide to us), such as:

  • Postal address and payment details when you place an order on our online store
  • Date of birth and/or confirmation that you are of legal age.
  • Your email address when registering for one of our promotions or newsletters
  • A record of the communication maintained with you (including any information you have provided in any of our products or services), if you have been in contact with our Customer Service department.

SOURCES OF INFORMATION

Most of the information we collect about you will be personal information that you have voluntarily provided to us through our website.

Global single sign-on allows deTule to identify you anywhere in the world, which prevents you from having to register again with us if you log in from another country.

  • Processing your order: we use the relevant personal information described above (including your name, address, and payment details) to process and deliver your order, and to inform you of the status of your order. Additionally, we may use your age, year of birth, or the confirmation of legal age required in Mexico to make online purchases, and if you are considered a minor for the purposes of the Data Law and/or any additional law regarding the commercialization of products.
  • Performing checks: we will also use your personal information to evaluate that your Credit or Debit Card is not categorized as fraudulent and thus avoid potential fraud. To this end, we may need to share your personal information with our credit scoring providers (see “How we share your personal information” below).
  • Customer Service: if you contact our Customer Service department (or vice versa), we will use personal information such as your order information and contact history to process your request and provide you with the best possible service.
  • Marketing: If you have given us your consent to send you marketing communications, we will use the information you provide when interacting with us to send you personalized marketing messages about deTule products, events, sweepstakes, and promotions. In some cases, we will also aggregate your personal information with that of other people, in order to create detailed reports on how customers use our products and services, and the experience they have with our brand.
    • Type of channels: we will send you direct marketing communications through the channel you choose, such as email, by phone, or on social networks. HOW WE SHARE YOUR PERSONAL INFORMATION

WITH SERVICE PROVIDERS

We share limited personal information that you provide to us (name, email address, password, and date of birth) with our cloud service providers for identification and authentication purposes, so that you can log into your deTule account in the quick and easy way you desire from anywhere in the world.

We will also share your personal information when necessary and only for the purposes described above with various third parties who will process your personal information on our behalf, such as third parties managing our loyalty program and/or prize contests/sweepstakes, hosting, delivery, payment, and anti-fraud management providers, as well as credit rating agencies and analytics platform providers. We require these service providers and other third parties to comply with strict rules when processing your personal information, including using your personal information only in accordance with deTule’s instructions and applicable laws.

REQUIREMENT BY COMPETENT AUTHORITY

deTule will disclose personal information when required by law or in a legal process, for the administration of justice, to protect your vital interest, for investigations conducted by law enforcement or regulatory bodies, to protect and defend the property and legal rights of deTule, to protect the personal safety of website users, or by order of a valid court order or authority in accordance with the Data Law.

WITH YOUR CONSENT

We will share your personal information with other third parties (other than those described above, for example, sports centers or gyms, or when you decide to connect our devices with devices from other manufacturers) in other limited circumstances. In such instances, when required by applicable law, we will obtain your express consent to share your personal information in this way.
